Animal Nuisance Ordinance

 

The City of Caspian Ordains:

Sec. 1 It shall be unlawful for any owner to fail to exercise proper care and control of his animals to prevent them from becoming a public nuisance. Excessive, continuous or untimely barking, molesting passersby, chasing vehicles, habitually attacking other domestic animals, trespassing upon school grounds, or trespassing upon private property in such manner as to damage property, shall be deemed a nuisance.

Sec. 2 No proceedings shall be instituted to enforce this Ordinance unless the complaint shall be signed by at least two (2) adult persons and investigated by the Twin City Police Department.

Sec. 3 Any person violating the provisions of this Ordinance shall be guilty of a misdemeanor, and upon the first conviction thereof shall be punished by a fine of not more than ($10.00) Dollars; and upon a second or subsequent conviction by a fine of not more than One Hundred ($100.00) Dollars or ninety (90) days imprisonment, or both such fine and imprisonment in the discretion of the Court.

Sec. 4 This Ordinance shall become effective twenty-one (21) days after its adoption and approval of the Mayor.
